New vehicle impoundment measures

This is interesting!

Excessive speed, stunting, racing or operating a motorcycle without a proper license, while not seated properly or while not following license restrictions will bring an immediate 7 day impoundment. Again, the Superintendent may choose to escalate the impoundment period for repeat offenders. (These motorcycle provisions will come into effect at a later date to be determined by the legislature.)

It's no wonder I have zero respect for the traffic law in this land....

My 19 year old son gave a buddy a very short ride on the back of a mini-bike on the side of a FSR and has been cited for endangering a passenger, no helmet, no insurance, no plate, failure to produce a m/c license....etc. He wasn't mouthy, made a dumb mistake, which he knows, but what he'll now pay in fines and loss of driving privileges is all out of proportion with what he did.
I'm not supporting what he did that evening, but I cannot support the action of the cop either.

So, now, it seems that a non-motorcycle riding legislator(wanna bet on that?) has decided that when I ( with only 45 years experience riding....still learning, too!! ) want to stretch my legs by standing up for a few minutes on my DRZ I am "stunting" dangerously. They can screw themselves!

I only posted the information about vehicle impoundments so we would all be aware of it. I did not intend it to be a session to complain about law enforcement.

Absolutely. The creation/application/enforcement of the law by those who barely understand it is a scary thing indeed.
Sadly, I've rarely if ever seen a police officer in this province obey the rules of the road themselves - and I'm talking basic safety; signalling, shoulder checks, paying attention to the road, etc... So, how does that enable them to determine whether a rider is "stunting", "not seated properly" or simply riding ?

The only sliver of hope re these pending restrictions, is the following excerpt:
(These motorcycle provisions will come into effect at a later date to be determined by the legislature.)

This is from the Motor Vehicle Act

250 "stunt" means circumstances in which, taking into account the condition of the highway, traffic,
visibility and weather, the driver or operator of a motor vehicle is driving or operating the motor vehicle
without reasonable consideration for other persons using the highway or in a manner that is likely to
cause harm to an individual or likely to distract, startle or interfere with users of the highway by doing
any of the following:
(a) causing any or all of the motor vehicle's tires to lift from the road surface;
(b) causing the motor vehicle to lose traction while turning the motor vehicle;
(c) driving the motor vehicle in a manner to cause the motor vehicle to spin;
(d) driving the motor vehicle in a lane intended for oncoming traffic for longer than necessary to pass
another vehicle;
(e) slowing or stopping the motor vehicle in a manner that prevents other motor vehicles from passing or
in a manner that blocks or impedes other motor vehicles;
(f) without justification, driving as close as possible to another motor vehicle, a pedestrian, or a fixed
object.

Passengers on motorcycles
53 A person must not ride as a passenger on the handle bars or frame of a motorcycle in front of the person driving or operating the motorcycle on a highway.
Permitting passengers on motorcycles
54 A person must not permit another person to ride as a passenger on the handle bars or frame of a motorcycle in front of the person driving or operating the motorcycle on a highway.
Operating motorcycle
55 A person must not drive or operate a motorcycle on a highway unless seated in the driver's seat of the motorcycle.

Excessive speeding
148 (1) A person who drives a motor vehicle on a highway at a speed greater than 40 km/h over the applicable speed limit set under the authority of an enactment commits an offence and is liable on conviction to not less than the aggregate of the fine amount and the applicable supplemental fine amount, if any, prescribed under section 148.1 for this offence and, subject to those amounts, section 4 of the Offence Act applies.

By the way, the Vehicle Inspection Manual requires that the bike be equipped with footrests if there is room on the seat for a passenger

"Excessive speed (which might become defined as 40kph over the posted limit), stunting, racing or operating a motorcycle without a proper license"

Sounds alright to me - I for one believe the traffic laws need more teeth. :clap:

Shuswap get you son to go to court or ask for a reduced fine. No need to go to court to dispute the fines but you are pleading guilty.

As for excesive speed...

As I understand it if you go more then 40 km over the limit they will (Or must?) Impound your car. Doing 70 in a 30 zone...yah you are going way to fast (over 2.3 time the limit) Doing 140 in a 100 zone? only 1.4 times the limit.

My understanding is that they are LOWERING the impound time for suspended drivers? Get real the people with suspended licences have them suspended for a reason.

We are allowing are politicians and the MOT to turn us into a nanny state.

When did we allow the police to become both the police and the courts? What happened to due process.

I predict a rise in police chases and traffic lawyers.

Oooh.. Oooh this applies to any Alberta plate driving in our province. They just don't get it. There outta be a law about hitting the brake lights on every corner they come across as well. Summer is over at last. Sorry thread drift.

One more quick note on my son's issue:
I have always taught my kids to be respectful of their elders, police officers, anyone, for that matter, regardless of the issue. And Ryan is always polite, even when he was getting plastered with these tickets. Kinda tough, considering these two officers were openly and loudly mocking him, and giggling about what charges they could come up with. Now, how do I get this kid-o-mine to see their point was valid when they treat a good kid, like him, in this manner?

Guess what I'm saying is that the less these judgmentally-limited folks have a chance to interpret the law, as it suits them to apply it, the better. I've lost confidence in too many of these officers.... as a group....due to many personally observed situations, never mind the almost-daily reports of unbelievably bad behavior/flawed judgment on their part.

Scoff-Law that I am, I routinely drive the Coquihalla at 150k, in company with many other folks, in a vehicle that is maintained to the nth degree, with top quality tires and an alert mind and eye....but only in the best of driving conditions and visibility. I'm now coming up on 39 years accident free, no critter has ever died under my wheels, I don't text while driving and it seems that I've always driven this way. But this fine bit of legislation-in-making will see my car impounded for 7 days?? (And, I suspect fines/fees will run into at least 1,000 bucks, or more.)

As the former Superintendent of Motor Vehicles said(Whitlock)..."what's the use in taking the licenses of our most heavily-ticketed drivers.......as they actually cause the fewest accidents"....NOTE: I Paraphrased Mr. Whitlock, as I don't have access to his exact words.

Yup, that'll teach me! The only thing we have going for us is that these power-laden bone-heads are spread too thin and lack the skills to catch most of us miscreates!

Oh, and by the way....spc?
With respect to your avatar: I have always slowed appropriately for emergency vehicles or for anyone stopped on the side of the highway, for that matter....I didn't need a new law to grant me the common sense to do that!!

OK, that's THE END of this rant!!

OK, that's THE END of this rant!!

If you want to rant about something then please start a post about it. But when I start a post to inform my follow riders about something we all need to know about, please do not rant about something another officer has done. Thank you.

threads are called such probably due to the unpredictable up over and thru paths that they may take, live with it. THE RANT was not yours (spc) but shuswap's, the info you provided (thank-you) merely provided the fuel.

Thanks spc for your inside knowlege of the rules and interpretation of the same. I think that most of us appreciate it. Don't get discouraged when things go sideways.

Thanx for the info on what COULD be a worst case scenario.It is always good to know how much you can lose should a guy get too stupid.As for cops it is the same as ANY job, you have great ones and lesser ones. I say your own attitude dictates your own outcome 99% of the time.
Beware for that OTHER 1% of the time

As much as I hate more laws to protect the stupid, I do agree the 90 in a 50 is criminal.. but then some of the posted speeds in this province are pretty poor too.
I just rode my CBR up to Duffy lake road and it's a great ride for sport or supermoto bikes, some of the corners posted speeds were 20k. Seriously if you need to be going 20k to take a corner, hand over the keys and take the fricken train.

This is going to be an interesting law, I hope enough people start getting active in these processes. The law is not a bad one in theory, but it needs to be amended for circumstances.
120 in an 80 zone, Fined X amount.
90 in a 50, shot on site
"stunting" needs to be very clear, not standing out of your seat, that's just ridonkulas

Don't confuse advisory speed signs (yellow) with regulatory speed signs (white). You can't be charged for speeding when exceeding the speed given on an advisory sign.

It's my understanding that corners are assigned speeds based not so much on how fast you can safely ride/drive around them, but by how fast you can get stopped if you need to, given the limited visibility of each corner. Having said that, 20km/hr still doesn't make a lot of sense. How fast can the average car/bike stop from 20 km/hr. 1 second?
