Well...that certainly took the wind out of my rant! :D

Nonetheless, I stand by what I said...although I will say that it was my LAST post on the subject...at least on THIS forum. Mushy isn't in the clear yet!

Tricky, Tom...very tricky!

We have to be carful when we get the tar buckets and feathers out.

Now you have the begining of a story, I might as well tell you the rest.

I Just finished jumping all the hoops and made all the modifications to make the bike street legal. I had all the paperwork with me and I was hoping to have time to stop at my local ICBC agent to finish the process and buy insurance. As usual we were running late so I did not have time. Now we go over to the island for the Orca DS and while at the mall there was an ICBC agent, so while the others were shopping I went to register the bike. When they entered the serial number is when I found out the bike was reported stolen. Thats all the agent could tell me, no details, if I wanted them I would have to go the the police. They gave me my paperwork back and sent me on my way. I didnt know what to do so I carried on the the Orca event

.........more to follow

Always take cash in a sale, and transfer the bike at the insurance broker with a seller... I have saved myself a few times... the stories and the anger these guys will give ya are ridiculous...

" O I have to work (always and constantly) ...."
"Look, you're paranoid... ya want it or you don't"
"Look I bought the bike used as a dirt bike... don't know if you can plate it... I'll get back to you with the vin"
"I got other buyers, don't waste my time"

Tom, you're more than justified to prevent the site from being used for character assassinations... The court of public opinion is far from rational and reasonable and can be abused far more easily than our legal system.

I made a post on this site late last year about how I ended up with a stolen bike.

The bike looked suspicious when I got working on it, it was a Yamaha Jazz scooter my daughter had given to her, and it was not worth much. But several things made me wonder about it.

I went to the ICBC website and searched the serial number, or maybe I called ICBC, dont remember for sure, but ICBC said they had no record but that there was a note on the serial number that said to call the RCMP. So I did and it had been reported stolen years earlier but because it was not registered at the time ICBC did not have record of that. Sothe RCMPcalled the original owner and he came by my place to get it. He brought a buddy and they were both very menacing in their approach to me so I called the person who gave it to my daughter. It had been through several hands 2 were farms that used it to putt around and one owned an auto parts recycling business who used it to ride around his yard but it looked like the person who stole it used it as payment for a bill they owed a small garage in Langley.

Having been with John Deere for a couple decades I have seen hundreds of lawn tractors purchased to replace stolen ones and have seen possibly a hundred stolen from the dealers yards and in the few instances where they are found they are always removed from the current "owners" possesion regardless of how they came to be in possesion of it.

I am surprised the police do not just seize this bike if it was reported stolen by the rightful owner. If your buddy has a stolen bike and lets you ride it and you get stopped should you go to jail or be charged? But the bike should be seized.

Good one Tom!. You do illustrate a very good point, but in some ways the principles and known facts in the two separate described incidents are somewhat different. I think we all learned some valuable lessons here. It is the buyer's responsibility to take all necessary means to ensure that you are not receiving or purchasing stolen goods, otherwise you are just encouraging the actions of criminals and at the same time creating more grief to yourself. One could just refer to the old adage that "If it's too good to be true, blah blah and so on"

The differences one could argue against, however whether fact, fabrication or speculation, Tom you probably didn't destroy your purchase within 24 hours upon receipt of said stolen merchandise. A normally sane individual, with an admiration for any form of motorcycling most likely wouldn't have performed this transaction on their recent investment.

So we all knew the facts, so to speak, putting two and two together and found this individual guilty and proceeded to portray it that way. Some of us perhaps jumped on the bandwagon based merely on emotion or personal experience, without considering the facts or lack thereof. Personally, I orchestrated my own decision based on the circumstantial evidence at hand, mixed with a little emotion. I certainly considered the details and drew my own conclusion that I had every reason to believe he was either the thief or had direct knowledge and/or participation in the crime. However emotional I am about the matter, I certainly leave a margin for the benefit of doubt. I don't believe any member would opt to "tar and feather" a marginal or possibly innocent individual. I can't speak for other members on how they derived their conclusions. I have no hesitation in this case to whether or not it was justified.

Now the topic was allowed to proceed for an extremely long time before the yank, so I could only assume the moderator(s) had an emotional stance on the issue before reflecting on his previous unfortunate escapade. However at this point the message was sent out loud and clear and in legal terms, far too late.

I myself, defend and stand by all my posts regarding the matter. No hesitation, no guilt and willing to spend the time and money needed against any libel or slander allegations.

Yes I am emotional about his matter! Someone out there is riding my brothers dr400, but this is the one I would love to have back, it's Vintage and belonged to my Father! This is not a picture of the beast but the picture portrays it to a tee! Nearly identical.

I understand Tom's point and perhaps we just move on and go ride as suggested by others. I can honestly say though without hesitation, we took a stance, made a bold statement, whether right or wrong. If wrong, as a membership I am willing to support the issue. Maybe now it's just time to move on, delete the threads and Go Ride!
